CPOPA Scope of Legal Services:

Disclaimer: A CPOPA member must be in good standing for sixty-days to receive full benefits. Legal services will be excluded on all past/pending incidents, to include any action arising from an incident that occurred before coverage was granted.


ACTIVE PEACE OFFICERS

LEGAL REPRESENTATION FOR MEMBERS IN GOOD STANDING FOR CRIMINAL INVESTIGATIONS AND PROSECUTIONS RESULTING FROM AN INCIDENT OFF-DUTY, WHERE THE MEMBER WAS ACTING IN THE GOOD-FAITH DISCHARGE OF HIS OR HER PEACE OFFICER DUTIES OR ACTING REASONABLY IN SELF-DEFENSE OR DEFENSE OF ANOTHER PERSON. MEMBERS INVOLVED IN AN INCIDENT INVOLVING THE USE OF A FIREARM MUST HAVE BEEN IN LAWFUL POSSESSION OF THE FIREARM. LEGAL REPRESENTATION WILL BE PROVIDED TO MEMBERS VIA NETWORK ATTORNEYS. THE BOARD RESERVES THE RIGHT TO EVALUATE THE REASONABLENESS OF A MEMBER’S ACTIONS AND APPROVE OR DENY COVERAGE. FACTORS THAT MAY LEAD TO A DENIAL OF COVERAGE INCLUDE, BUT ARE NOT LIMITED TO, GROSS NEGLIGENCE, MALICE, OR FRAUD. INCIDENTS INVOLVING INTENTIONAL CRIMINAL BEHAVIOR WILL NOT BE COVERED. MEMBERS INVOLVED IN INCIDENTS WHILE UNDER THE INFLUENCE OF ALCOHOL OR ANY INTOXICATING OR HALLUCINATORY DRUG MAY ALSO BE DENIED COVERAGE.


RETIRED PEACE OFFICERS

LEGAL REPRESENTATION FOR MEMBERS IN GOOD STANDING FOR CRIMINAL INVESTIGATIONS AND PROSECUTIONS RESULTING FROM AN INCIDENT WHERE THE MEMBER WAS ACTING IN THE GOOD-FAITH DISCHARGE OF HIS OR HER DUTIES AS A QUALIFIED RETIRED LAW ENFORCEMENT OFFICER OR ACTING REASONABLY IN SELF-DEFENSE OR DEFENSE OF ANOTHER PERSON. MEMBERS INVOLVED IN AN INCIDENT INVOLVING THE USE OF A FIREARM MUST HAVE BEEN IN LAWFUL POSSESSION OF THE FIREARM. LEGAL REPRESENTATION WILL BE PROVIDED TO MEMBERS VIA NETWORK ATTORNEYS.
